The terms that govern access to and use of AlwaysQA.

These Terms & Conditions (“Terms”) govern your access to and use of the AlwaysQA website, application, dashboard, API, MCP integration, CLI, coding-agent integrations, post-deploy QA features, AI-powered failure analysis, documentation, and related services (collectively, the “Service”).

The Service is operated by:

By accessing or using the Service, creating an account, starting a trial, purchasing a subscription, using credits, or otherwise interacting with AlwaysQA, you agree to these Terms.

If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to that entity.

The Service is intended primarily for business, professional, developer, and organizational use. If you purchase or use the Service on behalf of a business, company, organization, or as a professional user, you acknowledge that consumer withdrawal rights may not apply.

If you do not agree to these Terms, you must not use the Service.


1. Overview of the Service

AlwaysQA is an agent-first post-deploy QA service that helps developers, product owners, and coding agents verify whether critical web application flows still work after deployment. The Service may include features such as:

  • critical-flow checks after deployment;
  • QA-specific MCP actions for coding agents;
  • deployment history, check versioning, and fix-and-rerun workflows;
  • AI-assisted failure diagnosis;
  • regression bug validation, including uploaded bug lists or CSVs where supported;
  • screenshots, videos, logs, traces, and reports;
  • scheduled or deployment-triggered checks of application flows;
  • API, CLI, MCP, and coding-agent integrations;
  • integration with developer tools, issue trackers, repositories, CI/CD tools, or communication tools.

The Service is intended to assist with software quality assurance. It does not guarantee that your application, website, software, systems, flows, integrations, infrastructure, or third-party dependencies are error-free, secure, compliant, available, or suitable for any particular purpose.

The Service is not a penetration testing, vulnerability scanning, security audit, compliance audit, accessibility certification, cybersecurity certification, or legal compliance service unless expressly agreed in a separate written agreement.


2. Account registration and eligibility

2.1 Account creation

To use certain features of the Service, you may need to create an account. You agree to provide accurate, complete, and current information and to keep your account information up to date.

You are responsible for all activity that occurs under your account, workspace, organization, API keys, access tokens, MCP connections, CLI usage, coding-agent integrations, and connected tools.

2.2 Account security

You are responsible for maintaining the confidentiality and security of your login credentials, API keys, access tokens, test credentials, and connected integrations.

You must notify us immediately at hello@alwaysqa.com if you suspect unauthorized access to your account or any security incident involving the Service.

We are not responsible for losses caused by your failure to secure your account, credentials, test environments, integrations, or connected tools.

2.3 Business and professional use

The Service is primarily intended for business, professional, developer, and organizational use.

If you use the Service as a consumer, certain mandatory consumer protection rights may apply to you under applicable law. Nothing in these Terms limits rights that cannot legally be limited.


3. Customer Content

3.1 What is Customer Content?

“Customer Content” means any data, content, instructions, materials, code, URLs, test scenarios, test credentials, prompts, files, logs, screenshots, videos, traces, issue data, reports, or other materials submitted to, generated by, or processed through the Service by you or on your behalf.

Customer Content may include:

  • application URLs;
  • staging or production environment URLs;
  • test instructions;
  • test scripts;
  • screenshots and videos of test runs;
  • console logs;
  • network logs;
  • browser traces;
  • HTML snapshots;
  • issue descriptions;
  • repository or issue tracker metadata;
  • generated QA reports;
  • prompts and AI-generated responses;
  • test credentials or test accounts.

3.2 Ownership of Customer Content

As between you and us, you retain ownership of your Customer Content.

You grant us a limited, worldwide, non-exclusive, non-transferable license to host, access, process, transmit, display, reproduce, and use Customer Content only as necessary to:

  • provide the Service;
  • run tests;
  • generate and store reports;
  • provide support;
  • secure and maintain the Service;
  • troubleshoot issues;
  • comply with legal obligations;
  • enforce these Terms;
  • improve the Service as permitted by these Terms and our Privacy Policy.

3.3 Responsibility for Customer Content

You are solely responsible for Customer Content and for ensuring that you have all rights, permissions, consents, and legal bases necessary to submit Customer Content to the Service.

You represent and warrant that Customer Content and your use of the Service will not:

  • violate applicable law;
  • infringe intellectual property rights;
  • violate privacy, confidentiality, or data protection rights;
  • contain unlawful, harmful, or prohibited material;
  • expose us or others to legal, operational, financial, security, or reputational risk.

3.4 No obligation to monitor

We do not have a general obligation to monitor Customer Content. However, we may review, remove, restrict, or disable access to Customer Content if we reasonably believe that it violates these Terms, applicable law, third-party rights, security requirements, or our Acceptable Use Policy.


4. Customer responsibility for tested applications

You are responsible for any application, website, software, system, environment, or workflow that you test using AlwaysQA.

You represent and warrant that:

  • you own, control, or are authorized to test the target application or environment;
  • your testing activity will not violate laws, contracts, platform rules, third-party rights, or security policies;
  • you will not use the Service to test, scan, attack, overload, exploit, or interfere with systems you do not own or have permission to test;
  • you will configure tests in a safe and appropriate manner;
  • you will use test environments, sandbox data, or synthetic data where possible.

AlwaysQA is not responsible for damage, disruption, lockouts, rate limiting, data changes, charges, emails, transactions, user account changes, or other effects caused by tests you configure or run.


5. Production testing and destructive actions

5.1 Production environments

If you choose to run tests against a production environment, you do so at your own risk.

You are responsible for configuring tests, permissions, credentials, test data, rate limits, safeguards, and workflows to avoid unwanted effects.

Production tests may trigger real actions in your application or third-party systems. These actions may include:

  • purchases;
  • payments;
  • subscriptions;
  • account creation;
  • account deletion;
  • password resets;
  • email sending;
  • SMS or push notifications;
  • user invitations;
  • data creation;
  • data modification;
  • data deletion;
  • support tickets;
  • orders;
  • bookings;
  • API calls;
  • third-party integration actions.

5.2 Destructive and irreversible actions

You are responsible for ensuring that tests do not trigger destructive, irreversible, chargeable, unlawful, or unwanted actions.

You should configure safeguards such as:

  • dedicated test environments;
  • staging environments;
  • sandbox payment gateways;
  • test users;
  • feature flags;
  • confirmation screens;
  • restricted permissions;
  • rate limits;
  • allowlists;
  • test-only email inboxes;
  • mock integrations;
  • non-production API keys.

We are not responsible for any real-world action, cost, data loss, account change, communication, transaction, deletion, modification, or third-party consequence caused by tests you create, schedule, approve, or run.


6. Test credentials and test accounts

6.1 Use dedicated test credentials

You should use dedicated test accounts and test credentials whenever possible.

You should not submit real user credentials, production administrator credentials, private keys, production secrets, payment credentials, bank credentials, personal accounts, or sensitive credentials unless strictly necessary and covered by appropriate security controls and agreements.

6.2 Your responsibility for credentials

You are responsible for:

  • creating and managing test credentials;
  • limiting permissions granted to test accounts;
  • rotating credentials when appropriate;
  • revoking credentials when no longer needed;
  • ensuring credentials do not expose real user data or sensitive systems unnecessarily;
  • ensuring automated tests do not perform unwanted destructive actions.

6.3 Credential storage

If the Service allows you to store credentials, tokens, or secrets, we will use reasonable technical and organizational measures designed to protect them. However, no system is completely secure.

You remain responsible for deciding what credentials may be submitted to the Service and for using the minimum permissions necessary for testing.


7. Prohibited data

Unless we have expressly agreed in writing and appropriate safeguards are in place, you must not submit, upload, expose, or process through the Service:

  • health data;
  • biometric data;
  • genetic data;
  • racial or ethnic origin data;
  • political opinions;
  • religious or philosophical beliefs;
  • trade union membership;
  • sex life or sexual orientation data;
  • children’s data;
  • government identifiers;
  • payment card numbers;
  • bank login credentials;
  • private keys;
  • production secrets;
  • real user passwords;
  • regulated financial data;
  • data subject to special regulatory regimes;
  • data that you are not authorized to process.

If your testing workflow requires sensitive or regulated data, you should use anonymized, pseudonymized, masked, or synthetic data whenever possible.

You are solely responsible for ensuring that Customer Content submitted to the Service complies with applicable laws, including privacy and data protection laws.


8. Acceptable Use Policy

You agree not to misuse the Service.

You must not use the Service to:

8.1 Break the law or violate rights

  • violate any applicable law or regulation;
  • infringe intellectual property rights;
  • violate privacy, confidentiality, or data protection rights;
  • process data without required rights, permissions, notices, or legal bases;
  • impersonate any person or entity;
  • misrepresent your affiliation with any person or entity.

8.2 Attack, harm, or disrupt systems

  • attack, scan, probe, overload, disrupt, or interfere with systems you do not own or have permission to test;
  • conduct unauthorized vulnerability scanning, penetration testing, scraping, credential stuffing, brute force attacks, denial-of-service attacks, or exploitation;
  • bypass authentication, authorization, rate limits, or security controls;
  • introduce malware, spyware, ransomware, worms, trojans, or other harmful code;
  • use the Service to compromise accounts, systems, networks, or data.

8.3 Abuse the Service

  • reverse engineer, decompile, disassemble, or attempt to discover source code, models, systems, or internal architecture except where permitted by law;
  • resell, sublicense, rent, lease, or provide the Service to third parties without our permission;
  • use the Service to build a competing product or benchmark the Service for competitive purposes without our written consent;
  • interfere with the normal operation of the Service;
  • abuse trial accounts, credits, promotions, or usage limits;
  • create multiple accounts to avoid limits, billing, suspension, or enforcement;
  • remove, obscure, or alter proprietary notices;
  • use automated systems to access the Service in a way that violates our documentation or rate limits.

8.4 Misuse AI features

You must not use AI-powered features to:

  • generate malware, phishing, credential theft, or exploit instructions;
  • facilitate cyber abuse or unauthorized access;
  • create deceptive, fraudulent, or harmful content;
  • violate laws or third-party rights;
  • process prohibited data without appropriate authorization;
  • intentionally generate false, misleading, or defamatory reports about third parties.

8.5 Harm others

You must not use the Service to:

  • harass, threaten, abuse, or harm others;
  • send spam or unsolicited communications;
  • collect data from individuals without appropriate rights or notices;
  • test flows that trigger unwanted real-world effects, such as unauthorized purchases, account changes, messages, emails, charges, or user notifications.

We may suspend or terminate access if we reasonably believe you violated this Acceptable Use Policy.


9. Fair use and excessive usage

We may apply fair use limits to prevent abuse, excessive load, unreasonable costs, degraded service performance, or harm to other users.

Even if a plan is described as “unlimited” or includes high usage limits, usage must be reasonable, lawful, non-abusive, and consistent with the intended purpose of the Service.

We may restrict, throttle, suspend, or require an upgrade if your usage:

  • creates excessive infrastructure costs;
  • degrades service performance;
  • causes operational risk;
  • harms other users;
  • appears automated in an abusive way;
  • circumvents plan limits;
  • creates security or legal risk;
  • is inconsistent with normal business use.

Where reasonable, we will try to notify you before applying restrictions, but we may act immediately if necessary to protect the Service, users, systems, or third parties.


10. AI features and AI outputs

10.1 AI-assisted service

AlwaysQA may use AI systems to generate, execute, analyze, summarize, or triage QA tests, issues, logs, screenshots, videos, browser traces, and related Customer Content.

AI features may help you:

  • generate test cases;
  • convert natural language instructions into executable tests;
  • analyze failed test runs;
  • summarize errors;
  • triage issue reports;
  • suggest likely causes of failures;
  • prepare QA reports.

10.2 No guarantee of AI accuracy

AI-generated outputs may be inaccurate, incomplete, outdated, misleading, or unsuitable for your specific use case.

You are responsible for reviewing, validating, and approving all AI-generated check definitions, reports, summaries, issue triage, recommendations, and outputs before relying on them.

10.3 No professional advice

AI outputs and QA reports are not legal, security, compliance, financial, or professional advice.

AlwaysQA does not guarantee that your application is secure, compliant, defect-free, accessible, performant, or suitable for any particular purpose.

10.4 No AI training on Customer Content

Unless expressly agreed otherwise in writing, we do not use Customer Content to train our general-purpose AI models.

Unless expressly agreed otherwise in writing, we do not permit third-party AI model providers to use Customer Content to train their general-purpose AI models.

We may use aggregated, anonymized, or de-identified technical information to improve the reliability, performance, security, and usability of the Service, provided that such information does not identify you, your users, or your Customer Content.


11. Third-party services, models, browsers, and integrations

The Service may integrate with or depend on third-party services, including:

  • GitHub;
  • GitLab;
  • Slack;
  • Linear;
  • Jira;
  • CI/CD tools;
  • cloud providers;
  • issue trackers;
  • repositories;
  • communication tools;
  • analytics tools;
  • AI model providers;
  • MCP clients;
  • coding agents;
  • payment providers;
  • browser engines;
  • automation frameworks;
  • infrastructure providers.

Your use of third-party services is subject to their own terms, privacy policies, security practices, availability, and fees.

We are not responsible for third-party services, third-party content, third-party outages, third-party security incidents, third-party data loss, or actions taken by third-party providers.

Changes by third parties may affect test results, availability, pricing, performance, model behavior, browser behavior, integrations, or feature functionality.

You are responsible for configuring integrations safely and granting only the permissions necessary for your use case.


12. Subscriptions, credits, payments, and billing

12.1 Paid plans

The Service may be offered through free plans, trials, paid subscriptions, usage-based billing, credits, packages, or custom plans.

Prices, features, usage limits, billing periods, and included usage are described on our website, checkout page, order form, invoice, or applicable plan documentation.

12.2 Payment authorization

By purchasing a paid plan, subscription, credits, or other paid service, you authorize us and our payment provider to charge the applicable fees, taxes, and other charges using your selected payment method.

12.3 Payment processor

Payments may be processed by a third-party payment provider, such as Stripe. We do not intentionally store full payment card numbers.

Your payment provider may process payment data under its own terms and privacy policy.

12.4 Taxes

Fees are exclusive of taxes unless stated otherwise.

You are responsible for all applicable taxes, duties, levies, VAT, sales tax, use tax, withholding tax, or similar charges, except taxes based on our income.

If we are required to collect taxes, we may add them to your invoice or checkout total.

12.5 Subscriptions

If you purchase a subscription, it will renew automatically for the applicable billing period unless cancelled before the renewal date.

You are responsible for cancelling your subscription before renewal if you do not want it to continue.

12.6 Usage limits

Plans may include usage limits, including limits on:

  • test runs;
  • credits;
  • projects;
  • users;
  • workspaces;
  • stored artifacts;
  • test duration;
  • concurrency;
  • API calls;
  • scheduled runs;
  • integrations;
  • AI usage;
  • log or video retention.

We may enforce limits technically, charge for overages where disclosed, or require you to upgrade your plan.

12.7 Credits

If the Service uses credits:

  • credits may be consumed when tests are generated, executed, analyzed, scheduled, retried, or otherwise processed;
  • credit consumption may depend on usage, test duration, AI processing, browser execution, artifact generation, or plan rules;
  • credits may expire if stated at purchase or in plan documentation;
  • unused credits are not automatically refundable unless required by law or expressly stated otherwise;
  • credits have no cash value and cannot be exchanged for money.

12.8 Failed or delayed payments

If payment fails, is disputed, reversed, or overdue, we may:

  • retry the payment;
  • suspend access to paid features;
  • downgrade your account;
  • disable scheduled tests;
  • restrict access to artifacts or reports;
  • terminate your account;
  • recover unpaid amounts.

You remain responsible for all amounts due.

12.9 Chargebacks and payment disputes

If you believe a charge is incorrect, you should contact us first at hello@alwaysqa.com so we can review the issue.

If you initiate a chargeback or payment dispute without first contacting us, we may suspend or restrict your account while the dispute is investigated.

Chargebacks do not automatically cancel your subscription or terminate your obligation to pay valid outstanding amounts.

We may permanently suspend accounts involved in fraudulent payments, abusive chargebacks, repeated disputes, or payment method misuse.

12.10 Price changes

We may change prices, plan features, limits, or billing rules from time to time.

For active subscriptions, we will make reasonable efforts to notify you before material price changes take effect. If you do not agree to a price change, you may cancel your subscription before the change applies.


13. Cancellation

You may cancel your subscription according to the cancellation process available in your account settings, checkout provider, or by contacting us at hello@alwaysqa.com.

Cancellation usually prevents future renewals. It does not automatically refund past payments unless required by law or stated in these Terms.

After cancellation, you may continue to access paid features until the end of the current paid billing period, unless your account is suspended or terminated for violation of these Terms.

You are responsible for exporting Customer Content before cancelling, deleting, or terminating your account. We are not responsible for Customer Content that is deleted, disabled, or made unavailable according to our retention policy, these Terms, or applicable law.


14. Refund Policy

14.1 General refund rule

Except where required by applicable law or expressly stated in writing, payments are non-refundable.

This includes payments for:

  • subscriptions;
  • renewed subscriptions;
  • credits;
  • usage-based charges;
  • one-time purchases;
  • setup fees;
  • custom services;
  • add-ons;
  • overage charges.

14.2 B2B purchases

The Service is primarily intended for business and professional use.

If you purchase the Service as a business, company, organization, freelancer, or professional user, you acknowledge that consumer withdrawal rights may not apply.

14.3 Consumer rights

If you use the Service as a consumer and mandatory consumer protection laws apply, you may have rights that cannot be excluded by these Terms.

Where required by applicable law, we will honor mandatory cancellation, withdrawal, refund, or warranty rights.

If you request immediate access to digital content or digital services before the expiry of any statutory withdrawal period, you may lose the right to withdraw once performance has begun, to the extent permitted by applicable law.

14.4 Immediate access to digital services

By purchasing or activating immediate access to the Service, you request that we begin providing the digital service immediately.

If you are a consumer and applicable law provides a withdrawal right, you acknowledge that you may lose that withdrawal right once the Service begins, to the extent permitted by applicable law.

Where required, we may ask you to confirm this through a checkbox or other affirmative action during checkout or account activation.

14.5 Refund requests

You may request a refund by contacting hello@alwaysqa.com.

Refund requests should include:

  • your account email;
  • invoice or payment reference;
  • reason for the request;
  • relevant details about the issue.

We may approve or deny refund requests at our discretion, unless a refund is required by law.

14.6 No refund for misuse

We do not provide refunds for accounts suspended or terminated due to:

  • violation of these Terms;
  • abuse of the Service;
  • prohibited use;
  • fraud;
  • chargeback abuse;
  • unauthorized testing;
  • security abuse;
  • submission of prohibited data;
  • violation of our Acceptable Use Policy.

14.7 Service issues

If the Service is unavailable, delayed, interrupted, or fails to operate as expected, we may, at our discretion, provide reasonable credits, extensions, or refunds.

Such remedies are not guaranteed unless required by law or agreed in a separate written agreement.


15. Free trials, beta features, and early access

We may offer free trials, beta features, previews, experimental features, or early access features.

These features may be limited, unstable, incomplete, changed, suspended, or discontinued at any time.

Beta and early access features are provided “as is” and without warranties of any kind.

We may impose usage limits, eligibility requirements, or additional terms for free trials or beta features.

We may terminate or modify trials at any time, especially in cases of abuse, excessive usage, security risk, or violation of these Terms.


16. Service availability and no SLA

We aim to provide a reliable Service, but we do not guarantee uninterrupted, error-free, secure, or continuous availability.

Unless expressly agreed in a separate written agreement, we do not provide any service level agreement, uptime guarantee, support response guarantee, resolution time guarantee, monitoring guarantee, or service credit.

The Service may be unavailable due to:

  • maintenance;
  • upgrades;
  • infrastructure issues;
  • third-party provider outages;
  • security incidents;
  • abuse prevention;
  • force majeure events;
  • changes to third-party APIs, browsers, models, or platforms.

We may modify, suspend, discontinue, or limit any part of the Service at any time.

We are not liable for changes, suspension, downtime, loss of access, or discontinuation of features, except where required by law or agreed in writing.


17. Intellectual property

17.1 Our intellectual property

We and our licensors own all rights, title, and interest in and to the Service, including software, design, code, systems, documentation, workflows, models, interfaces, branding, logos, trademarks, and other materials.

Except as expressly stated in these Terms, we do not grant you any rights to our intellectual property.

17.2 Limited license to use the Service

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service for your internal business or professional purposes.

17.3 Feedback

If you provide feedback, suggestions, ideas, or recommendations, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

We are not obligated to use your feedback.

17.4 Intellectual property complaints

If you believe content processed through or made available via the Service infringes your intellectual property rights, contact us at hello@alwaysqa.com with sufficient information to identify the material, your rights, and the alleged infringement.

We may remove or restrict access to allegedly infringing content where appropriate.


18. Confidentiality

If either party receives confidential information from the other party, the receiving party must use reasonable care to protect it and must not use or disclose it except as necessary to perform under these Terms or as required by law.

Confidential information does not include information that:

  • is public through no fault of the receiving party;
  • was already known without confidentiality obligations;
  • is independently developed;
  • is lawfully received from a third party.

Customer Content is treated as confidential information, subject to these Terms, our Privacy Policy, and any applicable DPA.


19. Data protection and DPA requirement

Our processing of personal data is described in our Privacy Policy.

If we process personal data on your behalf as a processor, our Data Processing Agreement (“DPA”) applies.

If Customer Content includes personal data processed by us on your behalf, you must not submit such personal data unless:

  • you have a valid legal basis to process and submit that data;
  • you have provided all required notices;
  • you have obtained all required consents where necessary;
  • you have authority to instruct us to process that data;
  • you have accepted our DPA or entered into another written data processing agreement with us where required.

You are responsible for determining whether a DPA is required and for ensuring that your use of the Service complies with applicable data protection laws.


20. Export control and sanctions

You may not use the Service if you are located in, organized under the laws of, or ordinarily resident in a country or territory subject to applicable sanctions or trade restrictions that prohibit your use of the Service.

You may not use the Service if you are listed on any applicable restricted party, sanctions, denied persons, or export control list.

You may not use, export, re-export, or transfer the Service in violation of applicable export control, sanctions, or trade compliance laws.

You represent that you are not prohibited from using the Service under applicable sanctions, export control, or trade compliance laws.


21. Suspension and termination

21.1 Suspension

We may suspend or restrict access to the Service immediately if we reasonably believe that:

  • you violated these Terms;
  • you failed to pay fees;
  • your use creates security, legal, operational, financial, or reputational risk;
  • your use may harm us, users, third parties, or systems;
  • you are using the Service for prohibited purposes;
  • suspension is required by law;
  • your account has been compromised;
  • your usage is excessive, abusive, or inconsistent with fair use;
  • your tests may trigger destructive, unlawful, or unwanted actions.

21.2 Termination by you

You may stop using the Service at any time. You may request account deletion by contacting hello@alwaysqa.com.

21.3 Termination by us

We may terminate your account if:

  • you materially breach these Terms;
  • you repeatedly violate usage limits or acceptable use rules;
  • payment remains overdue;
  • your account is inactive for an extended period;
  • we discontinue the Service;
  • we are required to do so by law.

21.4 Effect of termination

Upon termination:

  • your right to use the Service ends;
  • scheduled tests may stop running;
  • access to reports, logs, screenshots, videos, traces, and Customer Content may be disabled;
  • unpaid amounts remain due;
  • we may delete Customer Content according to our retention policies;
  • provisions intended to survive termination will continue to apply.

22. Disclaimers

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • non-infringement;
  • availability;
  • accuracy;
  • reliability;
  • security;
  • compatibility;
  • error-free operation;
  • uninterrupted service.

We do not warrant that:

  • the Service will detect all bugs, defects, regressions, failures, vulnerabilities, or issues;
  • tests will always run correctly;
  • AI outputs will be accurate or complete;
  • reports will be error-free;
  • the Service will be available at all times;
  • the Service will meet your specific requirements;
  • your application will be secure, compliant, accessible, performant, or defect-free;
  • the Service will prevent downtime, data loss, security incidents, regressions, bugs, or business interruptions.

  • loss of Customer Content;
  • business interruption;
  • cost of substitute services;
  • failed tests;
  • missed bugs;
  • incorrect AI outputs;
  • application downtime;
  • destructive actions triggered by your tests;
  • unwanted emails, notifications, purchases, charges, orders, bookings, or data changes triggered by your tests;
  • security incidents caused by your configuration;
  • unauthorized access caused by your failure to secure credentials;
  • third-party services or integrations;
  • changes to third-party APIs, browsers, models, or platforms.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:

  1. the amount you paid us for the Service in the three months before the event giving rise to the claim; or
  2. EUR 100.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or other liability that cannot legally be excluded.

  • your tested applications or environments;
  • your production testing;
  • destructive or unwanted actions triggered by your tests;
  • your violation of these Terms;
  • your violation of law;
  • your violation of third-party rights;
  • unauthorized testing;
  • prohibited data submitted by you;
  • misuse of credentials, integrations, API keys, or connected tools;
  • your failure to secure your account or systems.

25. Governing law and jurisdiction

These Terms are governed by the laws of Poland, without regard to conflict of law rules.

Unless mandatory law provides otherwise, the courts competent for the registered business address of Maciej Chmura IdeaUnlock in Poland will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

If you are a consumer, you may have the right to bring claims in your country of residence where mandatory consumer protection laws apply.
